Allgemeine Geschäftsbedingungen — what you are buying, and on what conditions.

Read before you bid
Elite Club is a satirical public leaderboard. You are buying an
advertising placement and a digital image. You are not buying a security, an
investment, a share of anything, or membership of any real organisation, and the
titles conferred are decorative and carry no legal, civic or noble status.
1. Who you are contracting with
The ledger is operated by IP Strategy UG (haftungsbeschränkt), Neuss (“we”), whose
details are in the Impressum.
Dodo Payments acts as our merchant of record. That means Dodo is the
seller of record for the transaction: it takes the payment, handles VAT and sales
tax, and issues your receipt. Dodo's own buyer terms apply to the payment itself
alongside these terms. Everything about the listing, the ranking and the crest is
between you and us.
2. What is sold
A single purchase buys, together:
A ranked listing on the public ledger for one year, showing your name,
your link and your one-line description, positioned by total capital deployed.
A title corresponding to your total, as set out in the
Rules.
A numbered digital crest — bearing your house's mark (the emblem
published at the address you list, retrieved automatically where possible,
otherwise a gold monogram of your house name) and the regalia of your title,
supplied as a 1080 × 1080 image file for social use.
Delivery
The listing appears on the ledger once payment is confirmed. The crest is sent to
the email address on your payment automatically, typically within minutes of
confirmation and no later than 24 hours.
No physical goods are shipped.
What is not included
No guarantee of traffic, clicks, exposure, business outcome or return of any
kind.
3. How a contract is formed
Submitting a bid is an offer. The contract is formed when the payment is
confirmed and your listing is placed. We may refuse or reverse an entry, refunding
it in full, only on objective grounds: where the content standards in clause 6 are
not met, where Dodo Payments' acceptance policy prohibits the entry, where we are
required to by law or by a competent authority, or where we reasonably suspect fraud
or an unauthorised payment.
You must be at least 18 and legally able to enter a contract. Where you bid on
behalf of a business, you confirm you are authorised to do so.
4. Price and payment

Minimum entry
€1,000

€100
Annual Tribute (see clause 5)
€1,000 per year

You choose your own amount at or above the minimum, in increments of €100.
The full amount is charged at once when you pay. All amounts on this site are stated
exclusive of VAT. The tax-inclusive total for your location is displayed by Dodo
Payments at checkout before you confirm the payment, and appears on your
receipt.
5. Term, and the annual Tribute
A seat is held for one year from the date of purchase.
To keep the seat beyond that, an annual Tribute of €1,000 falls due on
each anniversary. It counts toward your cumulative total in the same way as any
other payment.
Not an automatic charge
The Tribute is not a subscription and your payment details are not
stored or charged again automatically. We send a reminder to your email
approximately thirty days before each anniversary, and you choose whether to pay
it. Nothing is taken unless you actively pay.
If the Tribute is not paid, your listing simply stops being shown. Titles already
earned and crests already issued remain yours; the seat does not. There is nothing
to cancel — not paying is the cancellation.
6. What you supply, and our standards
You provide a name, a link and an optional one-line description, and we may
retrieve the emblem or logo your site publishes at that address to render your
crest. You confirm that you own or are licensed to use all of it — the name,
the link, the description and that emblem — and you grant us a non-exclusive,
worldwide licence to display and reproduce it on the ledger, in the crest, and in
our own promotion of the ledger, for as long as your listing runs.
We refuse and refund entries that are unlawful or deceptive, that impersonate
another party, or that promote malware, adult content, gambling, weapons,
pharmaceuticals, hate material, or anything Dodo Payments' acceptance policy
prohibits.
7. Right of withdrawal
Consumers in the EU have a statutory right to withdraw from a distance contract
within fourteen days, without giving a reason. Your purchase has two components, and
the right works differently for each:
The crest — digital content. If you expressly consent to immediate
supply and acknowledge that you thereby lose the right, and we confirm that consent
to you on a durable medium, the withdrawal right for the crest expires when it is
supplied.
The one-year listing — a service. Even where you ask for it to
begin immediately, you may still withdraw within the fourteen days. If you do, we
refund the payment minus a proportionate amount for the period the listing has
already run at your request.
You are asked for the immediate-performance consent when you bid, and it is
restated in the order confirmation we email you. The full withdrawal instruction,
the model withdrawal form, and the effects of withdrawal are in the
Refund & Cancellation Policy, which forms part of these
terms.
8. Availability and liability
We aim to keep the ledger available but do not guarantee uninterrupted service.
We may change the design, the tier thresholds or the mechanics; changes do not
reduce a title already earned.
We are liable without limit for injury to life, body or health, for intent and
gross negligence, and under mandatory statutory liability. For slight negligence we
are liable only for breach of an essential contractual obligation, and then only for
foreseeable damage typical of this kind of contract, capped at the amount you paid.
Nothing here limits rights that cannot be limited by law.
9. Governing law and venue
These terms are governed by the law of the Federal Republic of Germany, excluding the UN
Convention on Contracts for the International Sale of Goods. If you are a consumer,
you keep the protection of mandatory provisions of the law of your country of
residence. For merchants, the place of jurisdiction is
Neuss, Germany.
Should any provision be invalid, the remainder stands.
